Custody, Support, and Mediation in Alabama

Custody decisions fall into two main categories. They are legal custody and physical custody

  • Legal custody determines who has the authority to make major decisions regarding a child’s upbringing, such as education, healthcare, and religious practice. 
  • Physical custody determines where the child will live and how parenting time will be divided. 

Custody can be awarded solely to one parent or jointly to both, depending on what the court deems to be in the child's best interests.

When judges evaluate custody arrangements, they look at a variety of factors: 

  • Each parent’s ability to provide a stable environment. 
  • The child’s emotional and physical needs.
